General terms and conditions of business



1. General

The following terms and conditions apply to all orders placed by the customer on LPN-Design, on the Pikas-Store website, the mobile website or in the mobile application.

By using or placing an order, you agree to the terms and conditions stated herein. Please read the terms and conditions carefully before placing an order.

Only adults who have a delivery address in Germany and who are not ordering for their commercial or self-employed professional activity or for that of a third party can place orders with us. Entrepreneurs within the meaning of Section 14 of the German Civil Code (BGB) are not entitled to place orders. We expressly point out that we will not issue invoices within the meaning of Section 14 of the German VAT Act (UStG).

The offering of any product or service on Pikas-Store.com at a particular time does not imply or warrant that such product or service will be available at any time. We reserve the right to discontinue any product at any time.

We reserve the right to change the Terms and Conditions from time to time without notice. The version of the Terms and Conditions applicable to your order is the version published on Pikas-Store.com at the time of your order. The Terms and Conditions applicable at the time of your purchase are not stored by us and cannot be requested from us.

You agree not to post, transmit, distribute, upload or market any information or content that could harm or negatively affect our business, products or services; not to behave in a way or use any device that restricts, impairs, hinders or compromises the security of other users of the Pikas-Store.com website; and not to use any device or module, software, tool, agent, script or other device or mechanism (including but not limited to spiders, bots, crawlers, avatars or intelligent agents) to navigate or search the website or to copy any content from the website. We reserve the right to block access to the website and close the account of any user who violates this provision or any other policies set out in these terms and conditions.

2. Prices and shipping costs

The prices indicated on Pikas-Store.com include statutory sales tax, but not shipping costs.

Shipping costs are the same for all orders, regardless of the size or weight of the package. The costs for each payment method are clearly displayed at checkout. Our standard shipping costs are €3.99. If we are unable to deliver your entire order and have to split it into several packages, there will be no additional shipping costs for subsequent deliveries.

3. Order / Conclusion of contract

Once you have placed your order and provided us with your email address, you will receive a confirmation email. If for any reason we are unable to fulfill the order, we will notify you. If we have already received payment for the order, we will refund the corresponding amount using the payment method you used. If for any reason a different arrangement needs to be made, an LPN Design customer service representative will contact you to arrange the refund.

The total amount for an order must be at least €1 (minus discounts).

4. Delivery

LPN-Design delivers your order to a private address or a pick-up point in Germany, according to the delivery option you have chosen.

LPN-Design endeavours to deliver items as quickly as possible in the order in which they are received. We aim to deliver within three to five days of receiving order confirmation, unless otherwise agreed. Although we will endeavour to deliver within the stated timeframe, delivery may take longer due to unforeseeable events. In the unlikely event that the delivery time is longer than 30 days, you may cancel the order.

Once you have placed your order and provided us with your email address, you will receive a confirmation email with the estimated delivery times.

5. Right of withdrawal

You have the right to cancel your order at any time within 14 days without giving any reason. The cancellation period begins on the day on which you or a third party other than the carrier designated by you takes possession of the last item in your order.

However, to comply with the cancellation period, it is sufficient if you inform us before the cancellation period has expired that you wish to cancel your order.

Consequences of revocation

We will refund all payments received from you in full without undue delay and in any event not later than 14 days from the day on which you have notified us of your cancellation. We will use the same payment method you used to pay for your order. There will be no additional costs for you. We may withhold reimbursement until we have received the items or you have supplied evidence of having sent back the items, whichever occurs first.

The goods should be returned or sent back to us immediately, but in no case later than 14 days after you have informed us of the cancellation.

You are only liable for any reduction in value of the goods if this is due to handling that goes beyond checking the properties and functionality of the items.

In any event, notification must be made within 14 days, as described in the "Right of withdrawal" section above. You will then have a further 14 days to return the items in accordance with paragraph 6 below (Returns and returns). We will refund the costs as soon as possible using the payment method you used.

If you have received a faulty item, please notify LPN-Design immediately and return the item in accordance with the provisions in paragraph 6 below (Returns and Returns). LPN-Design will fully refund the cost of products found to be defective. The provisions set out herein do not limit any applicable rights.

6. Return

LPN-Design will not issue a refund, credit your account, or replace any printed product unless

  • The product was printed incorrectly

  • The product was damaged during manufacturing (excluding damage during delivery)

  • the product does not match the order information (e.g. the printed image is incorrect or misplaced, the product is the wrong size, color or type, etc.).

It is at LPN-Design's sole discretion to issue a refund (including the refund method), credit your account, or replace a printed product. To request a refund, credit, or replacement, you must email LPN-Design a photo and brief explanation of the problem to lpn-design@outlook.de within 30 days of delivery.

For clarity, LPN Design will not issue a refund, credit your account, or replace a printed product because:

  • it was not satisfactory for any reason (other than the reconciliation of the fulfillment information provided)

  • the shipping service provider did not complete the delivery/the delivery was delayed

In such cases, you must place a new order or resolve the delivery dispute with the shipping service provider.

7. Payment methods
 We offer the following payment methods:

When placing the order, you can pay with a valid credit or debit card (VISA, Mastercard or American Express) and enter the card information. The corresponding amount will be immediately reserved on your card, but will not be debited until the goods have been dispatched from our warehouse. LPN-Design reserves the right to check the validity of the card, the available credit in relation to the order value and the buyer's address details. Based on the results of this check, we can also refuse orders.

PayPal
If you use the PayPal payment method, the corresponding amount will be immediately reserved in your PayPal account, but will not be debited until the goods have been dispatched from our warehouse. LPN-Design reserves the right to check the validity of the PayPal account, the balance to cover the order value and the buyer's billing address. We can also reject orders based on the results of this check.

Pay now
You pay securely via direct transfer using your usual online banking. Your online banking details are only entered in the secure payment form. LPN-Design cannot therefore access the data you enter or your account.

Miscellaneous
 You will receive the legally required invoice in the shipping confirmation email.

8. Warranty
 Nothing in these Terms and Conditions shall exclude or limit LPN-Design's liability where such exclusion or limitation would be contrary to applicable laws regarding the exclusion or limitation of liability.

LPN-Design will not be liable for death or personal injury caused by our negligence or that of our employees and agents. We do not intend to exclude liability for fraudulent misrepresentation by us, our employees or agents. If we breach these terms and conditions, we will only be liable for losses that are a foreseeable consequence of such breach.

LPN-Design will not be liable for indirect damages arising as a side effect of the actual loss or damage, such as loss of profits or orders, or for non-delivery of products or failure to comply with other obligations under these terms and conditions where the cause of such non-compliance is beyond our control, including but not limited to fire, flood, storm, riot, civil unrest, war, nuclear accident or terrorist activity.

Our maximum liability to you for any loss or damage arising from your order on Pikas-Store.com is limited to the total amount of your order.

9. Colors and dimensions
 We make every reasonable effort to accurately display the characteristics of our products, including their composition and colors. However, your display of colors will depend on your computer system and we cannot guarantee that your computer will accurately display colors.

The measurements of a product on Pikas-Store.com are approximate only to give you a more accurate idea of ​​the fit of a garment. The actual measurements of a product will vary depending on the material used to make it.

10. Warranty
 If the goods purchased are defective, LPN-Design undertakes to comply with all applicable warranty provisions. If you have a complaint regarding obvious material or manufacturing defects in the goods we provide, including damage caused during transport, please return the goods to us immediately.

11. Assignment
 LPN-Design reserves the right to assign or pledge all payment claims arising in connection with the delivery of goods, including all payment installments, to third parties.

12. Validity
 If any part of these Terms is unlawful or is found by a court or regulatory authority to be invalid, the remaining provisions will continue in full force and effect.

  1. Retention of title

    All intellectual property rights, such as trademarks and copyrights on AC-portable, remain with LPN-Design and its subsidiaries or licensees. The use of Pikas-Store or its contents, including copying and storing content in whole or in part, except for personal, non-commercial purposes, is not permitted without the permission of LPN-Design.
